This Privacy Policy describes how Organic 3, Inc. and its family of brands, including for example Smidge and Rosita USA (“Company”, “we”, “us”, or “our”) collects and uses the personal information you provide to us on our website and all other websites, mobile sites, applications, platforms and tools where this Privacy Policy appears or is linked, and through the use of our products, (collectively the “Site”). It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. 

We collect, use and are responsible for certain personal information about you. When we do so we are subject to various laws in the United States, and we are responsible as controller of that personal information for the purposes of those laws.

By creating an account, providing information to us (by any means, whether in correspondence, via our Site, or otherwise), or continuing to use our products, you acknowledge that you have read, understood, and consent to be bound by this Privacy Policy.

  • Unclassified – These are cookies that have not yet been categorized. We are in the process of classifying these cookies with the help of their providers.

Web Beacons

Our Site contains electronic images known as web beacons (sometimes called single-pixel gifs) and are used along with cookies to compile aggregated statistics to analyze how our Site is used and may be used in some of our emails to let us know which emails and links have been opened by recipients. This allows us to gauge the effectiveness of our customer communications and marketing campaigns. We use a third party to gather information about how you and others use our Site. For example, we will know how many users access a specific page and which links they clicked on. We use this aggregated information to understand and optimize how our Site is used.

Targeted Advertising

However, in a few cases, some of our Site features may not function as a result. Essential cookies cannot be rejected, as they are strictly necessary to provide you with our Site.

3. Do Not Track and Global Privacy Control.

Do Not Track (DNT) is a feature that individuals can enable on website browsers to request that websites and ad companies don’t track their web browsing activities. We do not respond to web browser DNT signals because no DNT standard has been adopted. 

Our third-party partners, such as web analytics companies and third-party ad networks, may collect information about you and your online activities over time and across our products and other online properties. These third parties may not change their tracking practices in response to DNT settings in your web browser and we do not obligate these parties to honor DNT settings. We utilize Google Analytics for our web analytics, and you can opt out of use of your usage data being included in our Google Analytics reports by following the links provided above. 

'Global Privacy Control' (GPC) is a browser setting that allows users to automatically communicate their privacy preferences, including to opt out of data sharing or selling across different websites. When you enable a GPC setting in your web browser, you are signaling these preferences across all websites that recognize this signal, including that you wish to opt out of the sale or sharing of your personal information. We do not currently support the GPC mechanism.


4. Testimonials.


From time to time, you may provide us with your story, comments, photos, or other feedback or testimonials (“Testimonial”). The provision of Testimonials is optional. We will obtain your consent before publicly sharing your Testimonial. If you consent to us publicly sharing your Testimonial, we may post the Testimonial on our Site or in our other marketing material to use such Testimonials as endorsements for our products and for the promotion of books and other education information. Please be aware that, once posted or distributed in our marketing materials, any personal information you submitted in your Testimonial can be read, collected, or used by the general public. We are not responsible for the use by any third party of personal information you choose to include in any Testimonial you choose to submit. 

5. Promotional Communications.

We may use your personal information to send you updates (by email, text message, telephone or post) about our products, including exclusive offers, cart reminders, promotions or new products.

We have a legitimate interest in processing your personal information for promotional purposes (see below “How and why we use your personal information”). This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly.

We will always treat your personal information with the utmost respect and never sell it to other organizations for marketing purposes.
You have the right to opt out of receiving promotional communications at any time by:

  • Using the “unsubscribe” link in emails or “STOP” number in texts.

6. How Your Personal Information is Collected.

We collect most of this personal information directly from you — in person, by telephone, text or email and/or via our Site. However, we may also collect information:

  • From publicly accessible sources;
  • From a third party (e.g., your bank or other payment provider when you make a purchase or attempt to make a purchase through the Site);
  • From cookies on our Site; and
  • Via our IT systems, including automated monitoring of our Site and other technical systems such as our computer networks and connections, access control systems, communications systems, and email and instant messaging systems.

7. How and Why We Use Your Personal Information.

    • To be as efficient as we can so we can deliver the best product for you at the best price;
    • To protect trade secrets and other commercially valuable information;
    • To prevent and detect criminal activity that could be damaging for us and for you;
    • To generate insights that power enhanced features from our service provider, Shopify;
    • To update and enhance customer records, to make sure that we can keep in touch with our customers about existing orders and new products and to market our products to existing and former customers, third parties who have previously expressed an interest in our products, and third parties with whom we have had no previous dealings; and
    • To promote our business to existing and former customers.

A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.

We may use your personal information for other reasons described at the time of information collection.

We may also anonymize, aggregate or de-identify personal information so the end-product does not identify you or any other individual. For example, we may use this information to generate norms by industry, geography, level, etc., enable us to understand where our products are being utilized, conduct ongoing validation studies, compile reports, and improve the products. Such aggregated, anonymized or de-identified information is not considered personal information for purposes of this Privacy Policy and we may use it for any purpose.

8. Who We Share Your Personal Information With.

We may share personal information with:

  • Our Affiliates and Subsidiaries. We disclose your personal information to other entities within our family of brands to fulfill any purpose described in this Privacy Policy.

  • Our Business Partners. We disclose your personal information to other companies with whom we partner to provide the Site and our products, to promote our products, offers, contests, or other promotions to our customers, and carry out other activities described in this Privacy Policy.

  • Our Service Providers. We disclose your personal information to third parties that provide business, professional, or technical support services to us and/or administer activities on our behalf. For example, we use Shopify to power our online store and Shopify will process your personal information when you visit and make purchases on our Site, including to provide services based on your interaction with other merchants and Shopify.   • Our Analytics Providers. We disclose your personal information to parties that assist us in performing analytics and help us measure the effectiveness of the Site and our marketing and advertising efforts.

  • Our Marketing and Advertising Partners. We disclose your personal information to our marketing and advertising partners, including social media networks, third-party advertising networks, and other parties that assist us in serving, measuring the performance of, and optimizing our advertisements.

  • Public posting and social sharing. When you share Testimonials or post public comments on our Site, on public forums like our social media sites, blogs, and online reviews, your comments are accessible by other members of the public.

  • Social media logins and other integrations. When you log into your customer account using your social media account credentials, or use other social media services with us, your personal information will be disclosed to the social media account provider in connection with your login. By doing so, you authorize us to facilitate this sharing of information, and you understand that this sharing is governed by the social media site’s privacy policy that you used to log into your account.

  • Governmental and Public Authorities. We disclose your personal information to government and public authorities as necessary or permitted by the laws of any jurisdiction in which we operate, including in response to a subpoena, court order, investigative demand, request for cooperation from a law enforcement agency, or similar request from a self-regulatory body or government agency.

  • Relevant Third Parties in Connection with a Business Transaction. We may disclose or otherwise transfer your personal information to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction as well as in the event of any insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.

The above excludes text messaging originator opt-in data and consent; this personal information will not be shared with any third parties.

We only allow our service providers to handle your personal information if we are satisfied they take appropriate measures to protect your personal information. We also impose contractual obligations on service providers relating to ensure they can only use your personal information to provide services to us and to you.

We may also need to share some personal information with other parties to the extent we believe it is necessary or appropriate to (1) protect our operations and those of our affiliates and subsidiaries; (2) investigate and prevent against fraud and other illegal activity; (3) protect our rights, privacy, safety, property, and/or those of others; or (4) allow us to pursue available remedies or limit damages that we may sustain.

We may disclose your personal information for other reasons described at the time of information collection or prior to disclosing your information. Additionally, we may disclose your personal information with your consent or when you direct us to do so.
Except as set forth above, we will not share your personal information with any other third party.

9. How Long Your Personal Information Will Be Kept.

We will keep your personal information while you have an account with us or while we are providing products to you. Thereafter, we will keep your personal information for as long as is necessary:

  • To respond to any questions, complaints or claims made by you or on your behalf;
  • To show that we treated you fairly;
  • To improve our security or detect and prevent fraud; or
  • To comply with legal or regulatory obligations or to keep records required by law.

We will not retain your personal information for longer than necessary for the purposes set out in this Privacy Policy. Different retention periods apply for different types of personal information. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of personal information; the potential risk from unauthorized use or disclosure of the personal information; the purpose(s) for which we use or may use the personal information; whether we can achieve the purpose(s) through other means; and the applicable legal requirements. 

10. Children and our Site.

Our Site is not directed to children, and you may not use our Site if you are under the age of 18. If you are under 18, do not use our products, access the Site, or provide any information about yourself including, without limitation, your name, address, email address or any screen name or user name you may use.

In compliance with the Children’s Online Privacy Protection Act, if we learn that we have collected or received personal information from a child under 13 without verification of parental consent, we will purge such information from our database and cancel the corresponding accounts. 11. Keeping Your Personal Information Secure.

We use reasonable and appropriate physical, technical, and administrative safeguards to protect your information from unauthorized use, access, loss, misuse, alteration, or destruction. We endeavor to protect the personal information we receive, gather and store, by such means as password protection, firewalls and other means. We limit access to your personal information to those who have a genuine business need to access it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality. We also require that third party service providers acting on our behalf or with whom we share your information also provide appropriate security measures in accordance with industry standards. We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

However, while we strive to protect your privacy, due to many reasons, including the inherent security flaws in the internet, we cannot guarantee the security of any information you disclose to us and, as such, you agree that your disclosure of such information is at your own risk.

12. Where Your Personal Information is Held.

Information may be held at our offices and those of our group companies, third party agencies, service providers, representatives and agents as described above (see above: “Who We Share Your Personal Information with”).

13. A Note to Users Outside of the United States.

Company is headquartered in the United States of America and utilizes service providers in the United States. The Site is not intended for Site visitors outside the United States and if we receive a purchase request from a visitor outside the United States, we may refer you to one of our European affiliates. If you are a non-U.S. user of the Site, by visiting the Site and providing us with data, you acknowledge and agree that your personal information may be processed for the purposes identified in this Privacy Policy. If you choose to access our Site outside the United States, Company and our service providers (including Shopify) may transfer your personal information to, or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. In particular, you are advised that the United States uses a sectoral model of privacy protection that relies on a mix of legislation, governmental regulation, and self-regulation. Where the laws of your country allow you to do so, by using the Site or purchasing products or by providing your data, you consent and authorize Company to transfer, store, and use all such personal information in the United States (and any other country where we operate) which may not offer an equivalent level of protection to that required in the country where you reside and to the processing of that personal information by us on our servers located in the United States, as described in this Privacy Policy.
